About Medical Malpractice

North Dakota has a two-year statute of limitations for medical malpractice claims. While this may seem like a reasonable period, many times the full extent of injuries cannot be known until well after the fact. For example, one client must wait to see if a remedy might restore his vision that was lost after a doctor failed to diagnose a treatable eye condition. Likewise, nerve damage or brain damage to newborns may not be discovered or fully realized until the baby is one or two years old.

You should contact an attorney as soon as you suspect malpractice. Attorneys Mark Larson and Leo Wilking consult with medical experts to gauge the prognosis for recovery and ongoing care needs, and to demonstrate how the doctor, nurse or medical staff failed to meet the accepted standard of care.

Federal Tort Claims

We have handled a number of medical malpractice cases against hospitals that are governed by federal agencies.

  • Air Force Base hospitals — A serviceman cannot file a claim against the government, but we can bring a claim on behalf of a dependent spouse or child. Mr. Larson recovered the largest settlement in state history for a stillborn baby. The delivering doctor at the North Dakota air base hospital failed to take the baby by C-section when the mother developed a fever; by waiting for a natural delivery, the baby also became fevered. The infant's distress was compounded when the mother was injected with a saline solution, resulting in the stillbirth.
  • Indian reservation hospitals — Larson Law Firm has also secured damages from care facilities on the Turtle Mountain and Fort Berthold reservations for medical malpractice. Mr. Larson is familiar with the special notification and filing requirements required by the government, as well as the unique federal court rules and procedures.

Mark Larson is a certified civil trial specialist by the National Board of Trial Advocacy. Although he achieves fair settlements in the majority of cases, he prepares for every personal injury case for the possibility of a trial.
